Article 23 paragraph (2) of Law Number 42 of 1999 concerning Fiduciary Security states that: "Debtors are prohibited from transferring, pawning, or renting to other parties objects which are objects of Fiduciary Security which are not inventory objects, unless in writing from the recipient in advance fiduciary. In the practice of leasing financing agreements, the debtor is transferring the object of the fiduciary guarantee without the approval of the creditor. This happened in the lease financing agreement between PT Adira Dinamika Multifinance and Debtors with the object of collateral in the form of a motorized vehicle.
This study research to explain the transfer of motorized vehicle collateral with fiduciary guarantees without creditors' approval. This research will also discuss the form of legal protection for creditors against the transfer of objects of fiduciary security.
The research method used is normative legal research methods. The materials used are primary legal materials, secondary legal materials, and tertiary legal materials. Primary data were obtained through interviews and field studies. Secondary data were obtained through document and literature study.
The results showed that the transfer of the fiduciary guarantee object in the leasing financing agreement resulted in the Debtor having committed default and illegal actions. Legal protection of Creditors' rights can be implemented through the registration mechanism for fiduciary security and the sale of fiduciary collateral objects through auction sales. Legal protection can also be carried out by loading objects with a fiduciary guarantee deed made with an authentic deed so that the principle of speciality emerges.
It is recommended to the legal leasing finance company PT Adira Multi Dinamika Finance to apply the principle of prudence in providing credit financing facilities. In order to prevent the transfer of the fiduciary security object without the creditor's approval, it is necessary to establish a publication digitization system for the object of the fiduciary guarantee.
