Article 31 of Constitution of the Republic of Indonesia of 1945 mentions that all Indonesian citizens have the right to get an education, it means everyone deserves to receive education without exception to the children in conflict with the law. Lembaga Pembinaan Khusus Anak (LPKA) Class II Jakarta hereinafter referred to as LPKA Jakarta is the place for children in conflict with the law to serve their detention period (specifically for crimes committed in Jakarta). In 2017, LPKA Jakarta was unable to provide educational activities since the allocation of fund was limited only for office administration, as well as the lack of experts in education department. This shows that LPKA has failed to carry out its development duties for children in conflict with the law as stipulated in Decree of the Ministry of Justice and Human Rights of Republic of Indonesia Law No. 18 of 2015 on Organization and Procedures for Lembaga Pembinaan Khusus Anak.
This research purposes are to perceive the protection of right to education for Children in Conflict with the Law in Indonesia and International regulations, and to discover how is the fulfillment of the right to education in LPKA Jakarta for Children in Conflict with the Law from January, 2018 until March, 2020.
This research uses normative empirical methods. It offers an overview of regulations regarding the right to education of Children in Conflict with the law, and analyzes the implementation of the right to education of children in conflict with the law in LPKA Jakarta.
As the result of this research, it is found that, the existing regulations in Indonesia regarding the education rights of children in conflict with the law are not violating International Human Rights Law; and children in conflict with the law at LPKA Jakarta from January, 2018 to March, 2020 still have not been able to receive Formal and Non-Formal Education.
It is suggested for the Indonesian legislator, to revise the National Education System to accommodate a provision regarding the standard education for children in conflict with the law; the LPKA Jakarta should also offer their full supports and efforts in achieving the fulfillment of the right to education by providing infrastructure to carry out formal and non-formal education for children in conflict with the law.
